On July 26, 1959, at 3:50 a. m., plaintiff-appellant Rausch was operating a motorcycle in an easterly direction along Forty-fifth street in the city of Kenosha. He noticed that Forty-fifth street became bumpy as it crossed the intersection with Twenty-sixth avenue. After he went an additional 50 feet on Forty-fifth street he saw something ahead in the street and, when his cycle upset, he was thrown to the ground, severely injuring himself. Further facts of the disputed accident are set forth in the opinion.
